Overview of Inphase Website Design Policy

This Policy governs the customer’s use of Inphase Website designing service and the company's responsibility to the client.

The Website Design Policy is part of the Inphase Website Hosing & Design Policies of which the AUP governs the use of our website or websites. The Design Policy does not intend to contradict, ignore, nor circumvent the AUP. Nor does the AUP intend to contradict, ignore, or circumvent the Design Policy.

By using Inphase Website Hosting & Design domain services, either by means of this website or by any other means, the customer enters into an agreement with Inphase and becomes bound by this policy.

 

Definition of Policy Terms

Inphase Website Hosting & Design may be referred to as we, our, us, company, or Inphase. Our customers may be referred to by terms as you, your, client, customer or user.

This policy may be referred to as policy, agreement, or contract.

 

Description of Website Design Services

Inphase defines website design as the process of utilizing several skills and technologies to construct a webpage, or pages, that can be viewed on the Web.

Web pages are coded with HTML (Hyper Text Markup Language; the coding language) to give a page its structure and CSS (Cascading Style Sheets) to give the page its individual style. Depending upon the purpose of the website, other scripting languages, as JavaScript and PHP, may be used to give the site specific functions.

 

Ordering A Website Design

Ordering a website design from Inphase Website Hosting & Design can be accomplished either by a personal contact with Inphase by office visitation, email, phone call or via Inphase's website. Either way, a personal account will be created on Inphase server so communications between you and Inphase can be established via the Internet and an order can be placed.

Responsibilities

Inphase Website Hosting & Design, as an independent contractor for the specific project of designing, developing, publishing and/or improving a World Wide Web site to the client’s Web space, guarantees the client that it has the experience and ability to perform the services required by this agreement and that it will perform these services in a professional, courteous, and timely manner.

The client certifies that he, she, or company or organization representative is at least eighteen years of age and therefore has the power to enter into the agreement of this policy as declared by a signed contract or by using Inphase's website.

The Client agrees that her/his/its performance of this policy or its associated contract shall not infringe upon or violate the rights of any third party or violate any federal, state, and municipal laws. 

The Client also authorizes Inphase to access the domain account and authorizes the ISP to provide Inphase with any necessary “write permission” for the Client’s Web page directory or any other directories or programs that need to be accessed for this project.

Completion Date

Inphase and you must work together to complete the Website in a timely manner. Much of this depends on receiving the appropriate images and text from you. Inphase and you agree to work in a prompt and efficient manner to complete the Website in a professional and timely fashion.

Long delays in receiving information will result in longer than usual completion dates and could incur unnecessary charges.

 

Creating A Personal Control Panel

When the client orders a website design (or any product or service) from Inphase Website Hosting & Design, a personal account control panel is created for the client.

The panel gives the client control of her or his Inphase account and establishes a way of communicating. Therefore, the personal information on the account will be accurate and provide a way to contact the client if needed.

The individual control panels are hosted on Inphase servers and are password protected.

 

Lawful Use of Website Design 

The customer agrees to use Inphase products and services in compliance with applicable law and Inphase’s Acceptable Use Policy which is hereby referenced in this agreement. 

The customer agrees that Inphase may, in its reasonable commercial judgment consistent with industry standards, amend the AUP and this policy from time to time to further detail or describe reasonable restrictions and conditions on your use of the products and services. 

Amendments to the AUP and the Website Design Policy are effective on the earlier of Inphase’s notice to you that an amendment has been made, or the first day of any Renewal Term that begins subsequent to the amendment. Notice may be made by email or posting on the website.

You agree to cooperate with Inphase’s reasonable investigation of any suspected violation of the Website Design Policy. In the event of a dispute between Inphase and the customer regarding the interpretation of this policy, Inphase’s commercially reasonable interpretation of Inphase Website Hosting & Design Policies shall govern.

 

Payments for Website Design Services

Inphase will keep design services competitive and below average for the DFW Metroplex area, but one-half of the design service, referred to as the initial payment, is required before design services begin unless otherwise noted in a seperate written agreement. The other half of the design fee, referred to as final payment, will become due after the design is completed and the client accepts the design.

Payments must be made in US dollars. Payments can be made by cash, creditcard, check, or money order.

 

Suspension/Termination of Design Services

You may terminate the design service at anytime. The design service starts when the initial payment is received by Inphase. The design fee, or porpotion, will be refunded under the following conditions:

Inphase may suspend a design service if the client prolongs giving the necessary files, documents, photos, or other informaiton necessary to complete the design. If a website is suspended, it falls within the following conditions:

 

Disclaimer to Website Design Services

While Inphase designs websites using approved design guidlines and the client's personal requests, it does not promise or guarantee that it can provide a website that the client likes. Inphase recognizes that all client's have their own likes, dislikes, and ideas of what a website consists. In such cases where the client can no longer be satisfied, Inphase reserves the right to stop the design process rather than prolonging something that can't be resolved.

Inphase guarantees that it will design a website that meets W3W recommended standards, but it does not guarantee that it will install all scripts, modules, or third party software to make the website function in a particular way.

Inphase also retains the right to evaluate changes requested by the client to the original design agreement after the design process has started and make additional charges for the design service.

 

Entire Understanding

Supporting Evidence

When you place an order with Inphase for website design, certian documents in the form of paper, Email, or other electronic and Internet documents will be generated which becomes binding and part of this policy. These documents give guidlines and instructions for the completion of the design.

Both parties understand that from time to time, it may be necessary to deviate from some of the guidelines stipulated in the obtained documents.  It is encouraged that both Inphase and you as the client keep all approved documents showing any changes to this agreement. Approved documents include, but are not limited to, email.

Authorship Credit

You may choose to allow Inphase to include a byline and link on the bottom (footer area of website) of your Webpage or pages that establish authorship credit. This byline is upon agreement by both you and Inphase and may be removed at any time upon request by either Inphase or you as the client.

Ownership 

Once the design charges have been satisfied and paid in full, the website becomes the property of the client. If the client wants the web files for the website, he or she is requested to submit an Email or by regular post stating the request. Inphase has the right to maintain a copy of the website files on its company computer.

Disagreement

If a disagreement is found between Inphase and the client regarding its website design (or other design services), then this Policy and its associated Design Worksheet shall be governed and construed in accordance with the laws of the State of Texas.  Both parties agree that if any part, term, or provision of this agreement shall be found illegal or in conflict with any valid controlling law, the validity of the remaining provisions shall not be affected thereby.
